These Terms of Service (“ToS”) form an integral part of the agreement (“Agreement”) between you (“Subscriber” or “you”) and Komprendo Labs AB (“Komprendo,” “we,” “us,” or “our”). They govern the delivery and use of the Services referenced in the Agreement. Capitalized terms not defined herein have the meanings given to them in the Agreement.
Any pilot account or Free Tier access is provided strictly on an “as is” and “as available” basis, without warranties of any kind. To the maximum extent permitted by law, Komprendo disclaims all obligations and liability (including those related to limitations set forth in Section 13 of the Agreement regarding liability) arising out of or connected to pilot accounts. This disclaimer includes any liability concerning Input (as defined in the Terms of Use). Any configurations, Input, or customizations associated with a pilot account may be lost if that account is suspended, terminated, or otherwise discontinued. Komprendo’s indemnity obligations set forth in Section 15 of the Agreement do not apply to pilot accounts.
Komprendo will deliver the Services described in the Subscription Service Order Form in accordance with the Agreement (as amended or updated from time to time).
(a) Komprendo AI Availability:
Komprendo AI typically operates continuously, 24/7, except during maintenance periods or other necessary downtimes. The Subscriber is responsible, at its own expense, for all telecommunications, hardware, software, internet connectivity, and firewalls needed to properly access and use the Services.
Unless otherwise stated in the Agreement:
(i) Komprendo does not provide warranties or support for Third‑Party Services;
(ii) The Subscriber assumes all responsibility for any Third‑Party Services, including any disclosure, alteration, or removal of Input by those services; and
(iii) Komprendo is not liable for, nor is the Subscriber relieved of its obligations or entitled to refunds, credits, or compensation, as a result of Third‑Party Service unavailability or changes affecting interoperability with the Services.
Komprendo will comply with all laws and governmental regulations applicable to its business operations.
Komprendo may engage subcontractors to perform the Services or meet other obligations under the Agreement. Komprendo remains responsible for the performance of these subcontractors and ensuring their adherence to the Agreement.
Komprendo will implement and maintain administrative, physical, and technical safeguards consistent with industry standards to ensure the security and integrity of the Services (“Security Measures”). Komprendo will process personal data in accordance with the instructions set forth in the applicable Data Processing Agreement.
